AI Painting Agreement

Effective date: June 22, 2026

This agreement governs the use of the AI painting service. You must read and agree to these terms before using the service.

Article 1 (Purpose)

This agreement aims to define the rights, obligations, and responsibilities between Photo Widget Inc. (hereinafter referred to as 'the Company') and the user regarding the use of the AI painting service (hereinafter referred to as 'the Service').

Article 2 (Definitions)

  1. 'Service' refers to all features that generate images according to user instructions using AI technology.
  2. 'User Content' refers to all data input by the user to use the AI service, including text prompts and selected styles.
  3. 'AI Generated Content' refers to all final results (images) created through the Service.

Article 3 (Service Use and Consent)

  1. The user must agree to these terms to use the Service.
  2. Users under the age of 14 may not use the Service regardless of parental consent, as per the Company's general Terms of Use.

Article 4 (Automatic Posting and Community Sharing)

  1. Public Posting: By default, AI Generated Content is published to the public “AI Wallpaper” menu within the Service, where the generated image and the prompt used may be viewed, liked, and saved (downloaded) by other users. The user may set their content to private to prevent it from being published to the community.
  2. User Interactions: Users agree that their posted content and service ID may be viewed, liked, and saved (downloaded) by other users.
  3. Prompt Sharing and Reuse: Users grant other users a non-exclusive license to copy and reuse their prompts to create new AI Generated Content. The user shall not claim any exclusive intellectual property rights over the prompts used within the community.

Article 5 (Ownership and License)

  1. Grant of License: By using the Service, the user grants the Company a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, and distribute the AI Generated Content and prompts for the purpose of operating, providing, improving, and promoting the Service. If the user deletes the content or their account, this license terminates; provided that this does not apply to content already published or shared within the community, content saved or reused by other users, or copies retained in routine backups.
  2. Reuse of Content: The user grants other users the right to use the generated results within the scope of the Service's community features (e.g., set as wallpaper, save to device).

Article 6 (User Responsibilities)

  1. Users must not use the Service to generate illegal content, sexually explicit material, or content that infringes on the rights of others (e.g., copyright, trademark, or portrait rights).
  2. Users are solely responsible for any legal issues arising from the prompts they enter or the AI Generated Content, and the Company is exempt from any liability.
  3. Users should not include any sensitive personal information in the text prompts, as they will be disclosed to the public.

Article 7 (Service Disclaimer and Limitations)

  1. Due to the nature of AI technology, results may be unpredictable or unintended, and the Company is not responsible for such outcomes.
  2. The Company does not guarantee the authenticity, accuracy, safety, or non-infringement of the AI Generated Content.

Article 8 (Governing Law)

The laws of the Republic of Korea shall be the governing law for the interpretation and disputes related to this agreement.

This agreement is effective from June 22, 2026.
